According to a report obtained by TMZ, cops say that Jacobs smelled of alcohol, and admitted to having, “”a moderate odor of an unknown alcoholic beverage”. However, cops said that they performed a sobriety test after taking Jacobs to the hospital, which he passed.

Furthermore, Jacobs admitted to falling asleep at the wheel before crashing his ride. While cops claim Jacobs passed his sobriety test, they reviewed surveillance from the crash and say they have enough to arrest him on suspicion of a DUI.

Jacobs plans on fighting this this case. “We intend to enter a not guilty plea on behalf of Mr. Jacobs if he is ever charged,” Jacobs’s attorneys David Z. Chesnoff and Richard A. Schonfeld said in a statement.

The 22-year old Josh Jacobs is coming of a very successful sophomore campaign in the NFL. He rushed for 1,065 yards and had 12 touchdowns.
